Please note that upon removal of the property, all sales are final. Description Warranty. Seller warrants to the Buyer that the property offered for sale will conform to its description. Any claim for misdescription must be made prior to removal of the property. If Seller confirms that the property does not conform to the description, Seller will keep the property and refund any money paid. Indemnification of PACRO To the fullest extent permitted by law, the Buyer shall indemnify and hold harmless PACRO, its Directors, shareholders, employees, and their respective consultants, agents and assigns, from and against all claims, damages, losses and expenses (including, but not limited to, fees and charges of attorneys, engineers, and other professionals, and court cost) arising out of or resulting from the buyer, except to the extent actively caused by a party identified hereunder. The buyer expressly accepts all liability for the equipment at the time it takes possession of the same. Claims indemnified hereunder shall specifically include, but not be limited to, any claims relating to bodily injury, sickness, disease or death and/or to injury to or destruction of property, including the loss of use thereof, and any claims related to environmental issues or claims associated with the transportation of equipment. Such obligation shall not be construed to negate, abridge or otherwise reduce any other right or obligation of indemnity which would otherwise exist for the benefit of PACRO.
