Condition: SEE DESCRIPTION *** SOLD AS IS *** Please note that our auctions do not extend. - Winning Bidders - The winning bidder will not receive their email immediately upon the end of auction. - Tax Exemption - Valid Florida resale certificates must be sent to SurplusAuctions@fdacs.gov as soon as possible. Taxes are adjusted manually. - Payment - PayMac handles all payments. Paymac initiates payments to FDACS (Seller) once a week. Items will be available within 7-14 business days upon confirmation of payment received by FDACS. Items will not be released until funds have been received by FDACS from PayMac, there are no exceptions. Timely payment will ensure timely pickup. - Pick up - The notice of award, payment receipt, and personal identification must be presented at time of pick-up, or the item will not be released. Basic Description : The purpose of this auction is to SELL 1 (one) galvanized steel fire tower, with the tower pylons. The Florida Department of Agriculture and Consumer Services (FDACS) intends to only sell the tower and not the property on which the tower is located. Buyer is responsible for: furnishing proof of liability insurance to the seller; the fire tower must be removed 30 calendar days after payment is received from Florida Department of Agriculture and Consumer Services property. Bidders are REQUIRED to remove the pylons, along with the tower. Bidders shall cause minimal ground disturbance when removing pylons, as well as return the ground to its previous state, including providing necessary fill dirt. This is a 100 ft. tower with a trap door entrance and a standard 8' X 8' ft. or 64 sq. ft. cabin. It was constructed in 1953 of galvanized steel with pressure treated wood steps and cabin floor, currently the wood steps are in poor condition. Site Visit/Inspection : Tower Location Oviedo Forestry Site at 250 County Road 419, Chuluota FL 32766 Located on the north side of CR 419, just east of Snow Hill Road 28 38 48.045 N 81 8 7.856 W An onsite inspection of the tower is recommended. All prospective bidders should perform their own due diligence prior to submitting a bid. Interested bidders may inspect the tower for sale prior to submission of bids. The bottom two landings of stairs have been removed and are not available. Due to the poor conditions and safety concerns of the remaining wood stairs, bidders are not allowed to climb the stairs in the interest of safety. Bidders shall consider all site conditions dealing with the removal of the tower and pylons from the Department property. To the best of the department s knowledge, no asbestos material was detected from the samples taken from the tower. The department will provide documentation upon request. By placing a bid, all Bidders acknowledge that they have read the attached survey and are accepting the conditions it describes AS IS, and with any violation of governmental, building, environmental, and safety codes that may exist in the Oviedo Fire Tower. Any Bidder hereby indemnifies, waives, releases, and holds harmless FDACS from all claims, causes of actions, costs and damages of any nature whatsoever (including attorney s fees and costs) arising from or in connection with the condition of the Oviedo Fire Tower, any known or unknown environmental hazard, contaminant, or condition at the time of the execution of the sale, including but not limited to, the presence of or subsequent removal of asbestos containing materials. The terms of this sale shall be binding upon the heirs, successors and assigns of the winning Bidder and shall survive the sale.
